A prominent San Antonio lawyer needs a lawyer.

  The District Attorney's office says Joe Ponce, 56, has been indicted on charges of felony theft and fiduciary misapplication.

  Prosecutors claim that ponce took money from the family of an incarcerated person which was intended 'to pay off restitution as well as facilitate the release of the family member from jail' and instead put the cash into his own pocket.

  The other charge involves allegations that Ponce took funds representing 'disputed divorce money' from the victim without her consent.'

  The theft charge carries a penalty of between 2 and 10 years in prison.  The Fiduciary Misapplication charge is a state jail felony, with a term of between 6 months  and two years.
